Check who the duty falls on before you go further. Where the work is done by a company’s own employees, that company normally carries the check. You may still have obligations of your own up the contracting chain, and the required clauses in the subcontract. If you are engaging one named person through their company, the substance of the arrangement matters more than the label. Take advice on this one.

3 · The right to work check
  1. Ask them for a share code. They generate it themselves at gov.uk/prove-right-to-work and it starts with W.
  2. Type the code and their date of birth below.
  3. Open the Home Office checker, enter the same code and date of birth, and enter your own business name when asked.

  4. Screenshot the result page. It must show their photo, the date, and what they are allowed to do.
  5. Upload that screenshot below.

British and Irish citizens cannot use the share code service. Take the original document, check it against the person in front of you, and photograph it.
